Dearborn Police Officer Acted In Self Defense In Fatal Fairlane Mall OIS

No Charges In Fatal Dearborn Officer Involved Shooting

The Wayne County prosecutors office have announced that the officer involved in the deadly officer involved shooting that claimed the life of a Detroit woman on January 27 2016 acted in self defense.

Investigations and eye witness testimony clearly showed the officer acted in self defense.

The shooting took place outside the Fairlane Mall in Dearborn. The woman, Janet Wilson of Detroit, was involved in an altercation with mall security earlier before Dearborn police arrived on the scene.

Witnesses stated she tried to run over mall security officers with her vehicle.

Upon arrival, Dearborn police officers attempted to stop her vehicle but were unsuccessful.

Wilson was stopped by traffic on Hubbard Street and it was then officers again attempted to take her into custody. She then used her vehicle as a weapon and attempted to strike the officers.

A Dearborn officer then fired his weapon at Wilson’s vehicle, striking it numerous times in the windshield and driver side window, some of those rounds stuck Wilson.

Wilson was transported to the hospital where she succumbed to her injuries.

It is well established that a police officer attempting to make a lawful arrest may use that force which is reasonable under the circumstances in his own self-defense.

Further, a police officer, by the necessity of his duties, is not required to retreat before a display of force by his adversary People v. Doss, 406 Mich 90 (1979).

In People v. Heflin, 434 Mich 482  at 502 (1990), the Michigan Supreme Court held that “the killing of another person in self-defense is justifiable homicide if the defendant honestly and reasonably believes that his life is in imminent danger or that there is a threat of serious bodily harm.

” Further, officers can be mistaken as to the degree of danger they are actually in, as long as their belief was reasonable under the circumstances.

In this case, multiple witnesses have stated that the vehicle was driven at Dearborn Police Department Officer 2 before he fired, and some believe he was struck by the vehicle before the shots were fired.

Witness accounts place Officer 2 within inches of the front bumper when the vehicle began to move.  Although he was not actually hit, the witnesses’ accounts substantiate how close he was to the car when Ms. Wilson began to drive.

The video shows Officer 2 backing away from her car as he continues to shoot. It does not make sense that he would move backward and discharge his weapon unless he felt the need to immediately move to a place of safety while Ms. Wilson’s car was moving.

This is especially true given how close his fellow officers were to the car and how many civilians were in the area.

Three of the bullets went through the front windshield on passenger side and one shattered the front passenger side window.

Ms. Wilson exhibited erratic and aggressive behavior at the Fairlane Mall that caused multiple people and security personnel to be placed in fear.

There is substantial evidence to show that Ms. Wilson was the initial aggressor and that her over 3,000 pound vehicle was used as a deadly weapon.

The Dearborn Police Department officers were informed by dispatch and Fairlane Mall security that Ms. Wilson had tried to run them down with her vehicle.

This information is important when considering Officer 2’s state of mind and reasonable belief that his life was in imminent danger or there was a threat of serious bodily harm.

In addition, her volatile and aggressive conduct was not an isolated incident. There are several incidents involving Ms. Wilson that were previously reported to the police, however, they did not result in criminal charges.  For example:

1. Family members were previously subjected to her physical attacks including an incident of felonious assault with a knife on a family member.

2. In October of 2015, after a confrontation with family members, she attempted to run down a U.S. Postal employee.

3. Police officers were subjected to assaults and combative incidents when called by the family, including biting, kicking, hitting, and deep scratch wounds.

Apprehension of a Fleeing Felon 

Currently, Michigan’s common law allows police officers to utilize deadly force when necessary to prevent the escape of a fleeing felon.

Michigan’s common law allows an officer to legally shoot and kill an unarmed individual who flees after committing a non-assaultive felony.

Under People v. Couch, 436 Mich 414, 461 NW2d 683 (1990), the Michigan Supreme Court stated that, until changed by the state’s legislature, it has been and continues to be that, under Michigan’s common law, an officer may utilize deadly force, when necessary, to prevent the escape of a fleeing felon.

The court further stated that Michigan’s common law does not distinguish between dangerous and non-dangerous felonies.  The Court declined to impose such a restriction, saying that the decision of whether police officers (or citizens) should be subject to criminal liability for the killing of a non-dangerous fleeing felon is a question for the legislature.

In the subsequent case of People v. Fiedler, 194 Mich App 682 (1992), the Fleeing Felon doctrine was narrowed slightly. Under Fiedler, it is required that an officer have both reasonable cause to believe that a felony has been committed and reasonable cause to believe that the person, against whom deadly force is used, committed the felony.

In this case, the Dearborn police had probable cause to believe Ms. Wilson had committed several felonies including Felonious Assault, Resisting and Obstructing and Fleeing and Eluding in the Third Degree.

The police tried to stop her car, but she attempted to flee by driving away when traffic cleared in front of her. A number of people were potentially in danger from Ms. Wilson’s actions.

They did not have time to move their cars to block her in and the use of a taser or pepper spray was not possible with her being locked in her car.

The use of deadly force (discharge of his duty weapon) was the only available means to immediately prevent her from escaping. In other words, the only means available to stop her from being a danger to others was to shoot.

13 Year Old Shot Dead By Brother In Another Detroit Accidental Shooting

13 Year Old Detroit Teen Shot Dead In Overnight Shooting

East Detroit’s 5th Precinct – December 21 2016: Another teen has been shot dead in an apparent accidental shooting on Detroit’s east side overnight.

Detroit Police officers from the 5th Precinct responded to the 700 block of Tennessee on the east side around 2:00am this morning on reports of a shooting.

Police officers arriving on scene discovered a 13 year old male had been shot by his 18 year old brother.

The young men were reportedly at the home by themselves and the circumstances surrounding the shooting are unknown.

Details on how they acquired the firearm are unknown at this time.

A Detroit EMS unit was dispatched to the scene with a 5-6 minute ETA, but officer’s on scene decided to transport the victim to St John Hospital at 2:07AM.

The teen died at the hospital.

Police believe the shooting was an accident.

This incident follows another accidental shooting of a 13 year old on December 12 2016. In that incident, a 13 year old was shot and killed on Detroit’s west side.

Former Buffalo Bill’s Football Player Robert Eddins Found Shot To Death In Detroit

Northwest Detroit – December 20 2016: Detroit Police were called to the 20300 Block of Pierson on Detroit’s northwest side early Tuesday evening around 6:00PM after the bodies of 2 black males were discovered in the basement of a dwelling on Pierson St.

One of those victims was later identified as former Ball State football player and Buffalo Bill’s linebacker Robert Eddins , 28, of Detroit.

Police found the 2 bodies of the men with multiple gunshot wounds after the father of Robert Eddins came home and discovered his son and another man, identified as 32 year old Ricky McFarland, shot multiple times.

Detroit Fire also dispatched an engine to the scene for a gas leak inside the dwelling.

Officers on the scene requested evidence techs and homicide investigators to the scene.

Robert Eddins attended Crockett High School (now closed) on Detroit’s east side from 2003-2006 where he lettered in football and was considered the 28th best football player in the State of Michigan at the time. Mr Eddins also made the Detroit News All Stars in his senior year.

While attending Ball State University from 2006 to 2010, he managed to again letter in football where his career sack total (17) ranks sixth in school history.

After going undrafted in the 2011 NFL Draft, Eddins signed as a free agent with the Buffalo Bills. He was placed on the injured reserve list on September 14, and waived with an injury settlement on September 20.

He was signed by the Bills to their practice squad on November 30.

On January 6, 2012, Eddins was signed to the Buffalo Bills. While making a rise up the depth chart in that summers training camp on August 21 in the Rochester, New York, Eddins was quoted as saying “Being inconsistent makes you non-existent”.

Mr Eddins played 1 game with the Buffalo Bills.

He was the son of Robert & Bridgett Eddins III.

Rashard Bell Sought For Shooting At Stardust Lounge

Inkster – December 17 2016: Inkster Police are seeking 28 year old Rashad Bell for the fatal shooting of a 25 year old male at an Inkster nightclub early Saturday morning.

Inkster Police were called to the Stardust Lounge at 3736 Inkster Rd at around 1:03am Saturday morning.

IPD received reports of a shooting at the club located on Inkster Rd & Carlylse St. When units arrived they found a 25 year old male had been shot and numerous patrons of the nightclub in the parking lot.

Inkster Police units then asked neighboring police agencies for help with scene containment. Officer’s on the scene reported numerous patrons were attempting to leave the parking lot.

The victim, a 25 year old male died at the hospital.

Police estimate as many as 50 people needed to be interviewed.

Inkster Police identified the shooter as 28 year old Rashad Bell.

Personal Responsibility And Bad Choices

Why do we always want to punish people over the bad choices others make in life?

Let’s look at a recent case in Detroit.

A gaggle of teens find a gun in their grandmothers bedroom; supposedly unloaded according to reports in the media, and use it to scare another teen to death…literally.

So the teens find the weapon, one of them loads it and giggling with anticipation they present the weapon to the dead teen in an attempt to “scare him”, the gun discharges striking the 13 year old in the chest, another promising young man in Detroit dead.

Why they loaded it if it was in fact unloaded, I don’t know, but let’s keep going here.

So I’m going with the lack of criminal intent, if only for this blog post. I’m sure the Detroit Police will determine intent during the investigation, but for now I’m going with the whole accidental shooting thing.

So, the teens in question, 3 of them ranging in age from 13-15 years old make a terrible choice and end up killing another.

The intent to kill wasn’t there in this scenario, just to scare the crap out of the dead teen if you’re to believe all the reports. I’m going to break all the rules and do just that right now.

They made a choice by removing the weapon and playing with it.

So now the police, Detroit in this case, are holding a hard working woman in custody because the gun she owns was insecure, unsecured…whatever.

This isn’t the first time that’s happened in Detroit, just the latest.

Choices

So we have 3 teens who made a bad choice and tossed personal responsibility out the window, a dead teen who’s only mistake was being in the wrong place at the wrong time, and a grandmother now facing a criminal record over those bad choices made by the 3 teens.

There are no laws in Michigan requiring owners of firearms to secure those firearms with gunlocks or safes.

There are laws on the books for control of firearms: (Page 156)

752.861 Careless, reckless or negligent use of firearms; penalty.

Sec. 1. Any person who, because of carelessness, recklessness or negligence, but not wilfully or wantonly, shall cause or allow any firearm under his immediate control, to be discharged so as to kill or injure another person, shall be guilty of a misdemeanor, punishable by imprisonment in the state prison for not more than 2 years, or by a fine of not more than $2,000.00, or by imprisonment in the county jail for not more than 1 year, in the discretion of the court.

Personal Responsibility

Does it make sense to have a weapon secured with a gunlock? Of course it does, especially when you have young children in the home.

In this case, I’d argue that teens ranging in age between 13-15 aren’t kids, though.

If the weapon is there for self defense, no. There are no weapons here that are secured by gunlocks. That would defeat the purpose of having the weapon ready for use in the case it was needed.

Example: Bad guy enters home, bad guy shouldn’t be in home, bad guy needs to be sent screaming to Hell for making a bad choice.

There are also no children present in our home. Zero, grandchildren or otherwise. None. Would those weapons be secured if there was, of course.

If our home is left unattended, yes, they’re secured behind a moat filled with Nile crocodiles.

If we make laws punishing people for the poor choices of others, what would stop our lawmakers from drafting a law punishing my wife if I went outside in slippers during a period of ice and snow, then fell on my fat ass when I slipped on a patch of ice? (This just happened, leave her alone, I made a bad choice)

We cannot legislate stupid, irresponsibility, carelessness. If there’s intent to harm, injure or maim, then yes, but there are laws on the books for that.

The Police Response

Police said they believe the shooting is a result of a gun owner failing to properly secure her weapon.

My Response

The Detroit Scanner believes the shooting is a result of stupid teens making stupid choices.

Update: Autopsy reports state the teen was shot in the back, not the chest. A game changer?
